Due Process of the Law

An important and valued goal in our society is preserving and protecting the
individual liberties that are found in the first eight amendments to the United States Constitution. Some of these highly valued rights are: the right to a speedy and public trial by an impartial jury; the protection against unreasonable searches and seizures; the freedoms from being tried twice for the same crime; and
the protection against self-incrimination.
Is it possible to effectively control crime in our society while at the same time protect the individual rights of the people from infringement by the government? Which side do you take: "The most important concern is that society must be made safer and criminals must go to jail" or "It is better that a guilty person occasionally remains free from going to jail than for individual rights to be eroded."

  1. I think it is more important for a safer society than letting the occasional guilty person let free. I don't want a murderer or rapeist being let free on the chance that the trial did not start quick enough. I want to know that the person has been put in jail and justice has been served. Why should they get let free? I know they have their rights but I would much rather have them be put away in jail then be let go on a small issue.

  2. I think it would be tough to effectively control crime in our society while also protecting the rights of individuals. I think that it is better for a criminal to go to jail and let some rights be eroded. But for those righrts to be eroded it has to be for the safety of the others around the person. If it is just because someone is suspitious then its not okay. It is okay to erode those rights if it keeps others safe.

  3. I would choose the first side, "The most important concern is that society must be made safer and criminals must go to jail". If society was run like that the world would be a safer place. A problem with this side is that their could be a chance of a trial being solved incorrectly. Yes, this is an issue, but that would be rare occasions and no one would know wether or not it was solved incorrectly. Being on this side, more criminals would get put in jail. That would mean our streets would be a safer place.

  4. I think if at all possible we need to protect the rights of individuals, but if there is a murderer at hand we need to do whats right. If that means we have to erode some of that persons rights just to keep them off the streets then its okay. We can eliminate the chance of the person committing the same crime or another crime if we have put the person in jail and do not give them time to be free before the trial.

  5. I think it is more important that criminals go to jail. While it is unfair for an innocent person to be sentenced to prison, someone who is guilty should NEVER remain free.

  6. I choose the first side. Criminals should go to jail in order to keep our society safe. If we just let people go, crimes will keep happening and people won't be afraid to do crimes either. The threat of jail also keeps people from doing such horrible crimes, so by putting people in jail, less crimes may occur.

  7. I believe that it is more important for citizens to have their individual liberties and freedoms. Sometimes, laws can be too strict and people may not feel protected by their law enforcements, rather they may feel scared. Civil liberties are granted to every American citizen and I for one believe that they should stay that way. I would rather let one criminal occasionally remaine free then to give up the rights that I was born with in this country.

  8. I think it is more important for criminals to go to jail. If a person commits a crime then they deserve the proper punishment. A guilty person should never remain free from jail.

  9. I would put more of an importance on the preservation of individual rights. If we give the government legal access into our personal lives, the envelope could be pushed too far limiting every one of our liberties and freedoms. No, the system is not perfect and guilty persons may be let off once in a while, but the process of law is well developed and will catch most guilty persons. Those who are occasionally let off are less of a threat to society than the imposition of an all-controlling government.

  10. It is very important for citizens to have their individual rights. Criminals should never be able to walk free. It's a terrible thing if a non guilty person is put in jail but we need to protect our society by any way that we can. Letting a guilty person free will never help make society a safter place

  11. I believe that protecting the rights of individuals is more important. There are many cases today where people are tried and freedoms and rights are taken away. Yes, criminals need to be locked up but there are also many times today where innocent people are guilty for crimes they haven't committed. Is it fair for them to be in jail for something they haven't done. Rights of individuals are so important and these rights are what makes us the great country that we are. We don't want them to be taken away.

  12. I would choose the side of, "The most important concern is that society must be made safer and criminals must go to jail". I don't think there is any circumstance that a person guilty of a crime should roam free just because their individual freedoms were violated. It bothers me that people get off for vicious crimes that they did commit but the defense just argues that their person rights were violated.

  13. I think that the rights of citizens should be important. I think depending on the evidence and if the defendant isn't totally shown to be guity or be undoubtedly convicted then they should be aloowed to be free. I do think that if a person can be charged by invading the defendant privacy or their rights, I think that they law should allow it.

  14. I think that rights of a citizen is very important to keep. But i think that a citizens right should be taken away if he is found for a crime. No gulity person should ever get away with a crime they commit. This would leave a better and safer socity

  15. I think that it would be better to protect the law and keep everyone safe rather then just protect the rights of one person that is guilty. I agree with the laws of everyone having a speedy trail and a fair trail but i still think its better to protect everyone over a couple people.

  16. I think that a safer society is better than having criminals on the streets. The more bad people we take off the streets the safer it will be. Trials usaully take awhile anyway so i much rather have them be in jail. They have rights but they are taken away when they commit a crime againest socity.

I would go with the side of "The most important concern is that society must be made safer and criminals must go to jail", because there are hundreds of criminals that should go to jail, but get off free because of a simple loophole such as an illegal search, or no search warrant. If the police have logical reason and suspicion that you are doing somehting illegal, they should have the right to check. I would rather be safe and have people go to jail that deserve it than have criminals get off scott free because even one of their rights are denied. I believe that they forfeit their rights as citizens as soon as they commit the crime.

  19. I think it is more important that our society is safe and that the ciminals do go to jail for doing something wrong. I don't think that they should be let free because chances are they will do the crim again. Every person has their rights but when they abuse them and do wrong they should have some sort of punishment.

  20. Controlling crime in our society far outweighs the importance of protecting an individual's rights set by the government. Of course the amendments are not something that should be pushed to the side completely, but they were created with the intent of making our nation a better place to live. In some situations bending the rules is required to do the right thing and lock away individuals who abuse the freedoms given to the people of the United States.

  21. Society must be safer and criminals deserve to go to jail. If it were any other way, I feel like the rules would be bent just to give criminals an easier way out. Criminals need to pay the consequences for their inappropriate actions, and hopefully improve their way of life afterward. The government can surely protect individual rights, but at the same time, we must maintain order in society to help with living more peacefully.

If someone knows what they did was wrong they should not get a second chance. getting a fair trial is very important as well. Criminals need to pay the consequences for what they did. Maintaining order in the court is a very important part to society.

If we as a society want things to be safer, which everyone desires, we must go to certain lengths to do so.

  24. The most important thing is to keep society safe. If rights are eroded for the better safety of the people, thats okay. If a murderer is let go due to eroded rights, even more lives can be lost. Stopping that is more important than overprotecting individual freedoms.

  25. It is better that a guilty person occasionally remains free from going to jail than for individual rights to be eroded. Individual rights and freedoms are the basis on which our country was founded. They define the American dream and if these "natural rights" according to John Locke are eroded, then so is the heart of our country. If an occasional criminal is released in the protection of our rights that so many have fought for, then while it may be a loss, it is a necessary one to protect ourselves and our country's integrity.

  26. It is almost impossible to have a safe society without violating some rights of individuals. In America we are given specific liberties such as the protection against unreasonable searches. In a sense, this protects the innocent and the not-so-innocent. The only way to secure a peaceful society is if we can bend some individual rights. I would rather be safe at the expense of the criminals.

  27. I agree that it is better that the occasionall guilty person remains free than erode the individual rights of another. What sets our country apart from the rest of the world is our constitution, and the personal freedoms it provides for our people on both a social and political level. Are founding fathers based our liberties off of these privilages, and too take them away contridicts the foundations of our country. I'm not saying letting a guilty person back on the streets is acceptable; but it is controlable. Taking rights away can lead to nothing but anarchy; that is uncontrolable.

  28. It is of utmost importance for criminals to be in jail in order to keep our society safe. A criminal that is let go causes more problems on the street than a hurt feeling of someone who thinks his rights were eroded. At times we must put aside what Americans believe is an individual liberty, and protecting the safety of our citizens is one of these times.

  29. i take the side of crimals have to go to jail. i believe that is more important that we take criminals off the street. i believe that in these situations is when it is right to do this because its making the streets and homes of citizens more safe and that is what is supposed to be done.
